California Statutory Probate Attorney’s Fees and Executor Commissions

The probate code in California establishes a fixed fee for attorneys and personal representatives (also known as executors) who oversee the management of a deceased person’s estate. This fee is outlined in California Probate Codes 10800 and 10810. However, if extraordinary services are provided, the court may permit attorneys and personal representatives to receive an amount exceeding the standard fee in exceptional circumstances.
